Terms of Service

1. The agreement

These Terms govern the Nibbii macOS and iOS apps, Nibbii Pro, Managed AI, and related online services (together, "Nibbii" or the "Service"). Please also read our Privacy Policy. If you don't agree, do not use Nibbii.

Nothing in these Terms affects statutory consumer rights that cannot be excluded or limited.

You must be at least 13 to use Nibbii. If you are under 18, ask a parent or guardian before making a purchase.

2. Who we are

Nibbii is made and operated by Ashneil Lanelle, a UK-based sole trader. You can reach us by email at hello@nibbii.pet or by post at 315 Wilmslow Road, Manchester M14 6XS, United Kingdom.

3. Your app licence

We grant you a personal, worldwide, non-exclusive, non-transferable licence to use Nibbii on Apple devices you own or control. Some Mac releases may be sold as a one-time direct licence. The iOS app is downloaded through the App Store and offers optional auto-renewing Nibbii Pro subscriptions.

You agree not to:

• copy, resell, sublicense, rent, or redistribute the app or a licence key;
• share, publish, or resell licence keys, or use a key you did not obtain legitimately;
• reverse-engineer, decompile, or circumvent licensing or technical protections except where law expressly permits;
• use Nibbii unlawfully or infringe another person's rights.

Your pet data and conversations remain yours. The app, code, artwork, sprites, and Nibbii branding remain ours, subject to third-party licences.

4. AI features & acceptable use

Nibbii's chat can run in three modes: fully on-device, with your own AI provider key, or through our optional Managed AI plan. How your data is handled in each is described in the Privacy Policy.

• Bring your own key: you're responsible for obtaining your own API key and for complying with your chosen provider's terms and usage limits. Any charges from that provider are between you and them.
• You're responsible for what you send. Don't use Nibbii's AI features to create or transmit unlawful, harmful, infringing, or abusive content, or to attempt to break, overload, or misuse the Service or any provider behind it.
• AI output isn't reliable advice. Responses are generated by an AI model and may be inaccurate, incomplete, or unsuitable. Don't rely on them as professional, legal, medical, financial, or safety advice. You're responsible for how you use anything the AI produces.

5. Nibbii Pro, Managed AI & billing

Nibbii Pro is optional. It unlocks the features described in the app and includes the Sparks allowance shown at purchase. The exact price and billing period are the localized values displayed by Apple StoreKit or Stripe before you confirm.

• Renewal: a subscription renews automatically for the displayed period at the displayed price until cancelled.
• Apple subscriptions: Apple bills the payment method attached to your Apple Account. Manage or cancel in iOS Settings or the App Store subscription page. We cannot cancel an Apple subscription for you.
• Stripe subscriptions: manage them through the available billing portal or contact us for help.
• Sparks: recurring allowances are granted after a verified purchase or renewal. If Sparks run out, Nibbii does not automatically make an extra charge.
• Cancellation: stops future renewal. Access continues for the paid period unless the provider or law says otherwise. Deleting a Nibbii account does not itself cancel billing.

6. Trials and starter Sparks

A new eligible device may receive a one-time Nibbii Pro trial and welcome Sparks. Apple may also offer an introductory trial on an eligible StoreKit subscription. Eligibility rules are enforced separately by Nibbii's device-security service and by Apple, so reinstalling or creating a new anonymous account does not guarantee another trial. The app shows the applicable trial and renewal terms before purchase.

7. Payments & taxes

iOS purchases are processed by Apple through StoreKit and are subject to the App Store's payment terms. Direct Mac and web purchases are processed by Stripe. By confirming a purchase, you authorise the displayed charge and, for a subscription, recurring charges until cancellation. Prices and taxes are shown by the applicable storefront before purchase. We do not receive complete card details.

8. Refunds & cancellation

We want you to be happy with Nibbii.

• Apple purchases: cancel an auto-renewing subscription through Apple. Apple controls App Store refunds; request one through Apple's “Report a Problem” service or Apple Support.
• Direct purchases: contact hello@nibbii.pet. Any advertised money-back guarantee applies in addition to statutory rights.
• Top-up credits: one-off credits are generally non-refundable once used, except where law or the payment provider requires otherwise.

Nothing here limits mandatory consumer rights, including remedies for faulty or misdescribed digital content.

9. Updates & changes to the app

Mac updates may be offered through the built-in updater; iOS updates are delivered through the App Store. We may fix, improve, add, or occasionally remove features and may discontinue parts of the Service with reasonable notice where practical.

10. Third-party services

Nibbii relies on services including Venice AI, Apple StoreKit, App Attest, DeviceCheck, Stripe, Cloudflare, Vercel, Hugging Face, and Open-Meteo. Features that depend on them may also be subject to their terms.

11. Intellectual property

Nibbii, including its software, source code, artwork, animations, sprites, sounds, and the "Nibbii" name and logo, is owned by us and protected by intellectual-property laws. These Terms grant you a licence to use the app, not any ownership of it. Third-party open-source components are used under their own licences (listed in the app's third-party notices). Content you create with Nibbii (your pet, its memories, and your conversations) belongs to you.

12. Disclaimers

Nibbii is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we don't warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose, or that AI output will be accurate. Nibbii is a companion app made for enjoyment. It's not a productivity, safety, or professional tool. This clause does not exclude any warranties or rights that the law does not allow us to exclude, including your consumer rights.

13. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under applicable law, including your statutory rights as a consumer.

Subject to that, we will not be liable for indirect, incidental, special, or consequential losses, or for loss of data, profits, or goodwill, arising from your use of Nibbii; and our total liability to you for any claim relating to the Service will not exceed the greater of the amount you paid us for Nibbii in the 12 months before the claim, or $29.

Because your pet's memories and conversations are stored on your own device, please keep your own backups of anything that matters to you. Nothing in this section limits your non-excludable rights and remedies under the Consumer Rights Act 2015, including repair, replacement, or a refund for faulty digital content, and compensation if digital content we supplied damages your device.

14. Termination

You can stop using Nibbii at any time and uninstall it. We may suspend or end your access if you materially breach these Terms (for example, by pirating the app, abusing the AI features, or attempting to harm the Service). If we end your access for a serious breach, the one-time app fee is non-refundable; for the Managed plan we'll refund any prepaid amount for service you haven't yet received, keeping only the value already used plus any reasonable losses, except where the law requires otherwise. Terms that by their nature should survive termination (such as intellectual property, disclaimers, and liability) will continue to apply.

15. Changes to these terms

We may update these Terms from time to time, for example to reflect new features, changes in the law, or the cost of providing the Service. We'll post the new version here with an updated effective date, and for significant changes we'll try to give you reasonable notice. If a change materially and detrimentally affects a paid subscription you already hold, we'll give you reasonable notice and you may cancel and receive a pro-rata refund of any prepaid, unused amount. Continuing to use Nibbii after changes take effect means you accept the updated Terms.

16. Governing law

If something's wrong, please email us first. We'll do our best to sort it out. These Terms are governed by the laws of England and Wales, and disputes will be subject to the courts of England and Wales. If you are a consumer resident elsewhere, you may also have the benefit of mandatory protections and the right to bring proceedings in the courts of your country of residence.
